Shaft of Plenty Limited – Terms and Conditions of Sale

These terms and conditions apply to the purchase and use of The Shaft of Plenty hip flask, sold by Shaft of Plenty Limited (“we”, “us” or “our”).   By purchasing from our website or an authorised online store, you agree to these terms.     

1. Product Use

• This hip flask is intended for personal, non-commercial use to carry legal beverages.

• This flask is designed for recreational use, including on golf courses. It remains your responsibility to comply with all rules and regulations at any venue or sporting facility.

• Do not use this product while driving or operating machinery. Always consume alcohol responsibly.

• Do not use with carbonated, perishable, or acidic liquids, or store liquids for extended periods.

• Not suitable for use by individuals under the age of 18.

• Improper use may result in damage or risk of pressure build-up.

• This product is intended only for carrying water or alcoholic spirits. It must not be used to store milk, juice, soft drinks, carbonated beverages, hot liquids, or any perishable liquids. Use of unsuitable liquids may damage the product and could pose health risks, for which Shaft of Plenty Limited accepts no liability.

2. Legal Age Requirement

• You must be 18 or over to purchase or use this product in the United Kingdom.

• By completing your purchase, you confirm you meet this legal requirement.

3. Health & Safety Guidelines

• Wash the flask before first use and after each use with warm, pH-neutral soapy water.

• Do not use bleach, abrasive cleaners or microwave the product.

• Dishwasher use to clean the brass base collar and cap is not recommended. The stainless steel shaft is dishwasher safe.

• Always consume alcohol responsibly. Shaft of Plenty Limited accepts no liability for misuse of alcohol.

• This product is not intended to diagnose, treat, cure, or prevent any health condition. Shaft of Plenty Limited accepts no liability for any illness, allergic reaction, or other adverse effects arising from the type of liquid stored in or consumed from this product.

• Failure to clean the product properly between uses may lead to bacterial growth or contamination. Shaft of Plenty Limited accepts no liability for illness or injury arising from improper cleaning, maintenance, or storage of the product.

• Shaft of Plenty Limited is not responsible for the consumption of any liquids stored in this product, nor for any consequences of alcohol misuse, intoxication, or unlawful behaviour (including drink-driving).

• For hygiene reasons, we cannot accept returns of flasks that have been used, unless they are faulty.

4. Returns and Consumer Rights

• You may cancel your order within 14 days of delivery under the Consumer Contracts Regulations 2013.

• Products must be unused, in original packaging, and in resaleable condition.

• Faulty, damaged, or misdescribed items are eligible for repair, replacement, or refund under the Consumer Rights Act 2015.

• Return postage is covered only if the product is faulty.

• Normal cosmetic wear (including scratches or dents caused by carrying in golf bags) is not covered under warranty.

5. Warranty

• We offer a 30 Day manufacturer’s warranty covering defects in materials or workmanship under normal use.

• The warranty does not cover:

   o Accidental damage or misuse

   o Wear and tear or cosmetic scuffs, or patination and tarnishing of brass fittings over time.

   o Improper cleaning (e.g. dishwasher use unless stated as safe)

• This warranty does not cover any health-related claims, including but not limited to alleged contamination, illness, or adverse effects resulting from use of the product.

6. Liability

• We are not liable for indirect, incidental, or consequential losses from the use or misuse of this product.

• Nothing in these Terms limits or excludes liability for death or personal injury caused by our negligence or affects your statutory consumer rights.

• To the fullest extent permitted by law, Shaft of Plenty Limited shall not be liable for any health issues, illness, or injury arising from the use or misuse of this product, except where directly caused by a manufacturing defect.

7. Intellectual Property

• All branding, product design, packaging, and trademarks (including The Shaft of Plenty™) are the exclusive property of Shaft of Plenty Limited.

• Commercial resale is prohibited without written permission.

• Unauthorised use or reproduction is strictly prohibited.

8. Privacy & Data Protection

• We collect and process personal data in accordance with the UK GDPR and the Data Protection Act 2018.

• Your data is used only for fulfilling orders, customer service, and (if consented) promotional emails.

9. Governing Law and Jurisdiction

• These Terms are governed by the laws of England and Wales.

• Disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
